Obama-appointed judge has blocked a state ban on food dyes in West Virginia.
Judge Irene Berger ruled against the state of West Virginia and in favor of a conglomerate of dye manufacturers to halt a ban on the use of artificial food dyes in the state.
The ban, which had the backing of Governor Patrick Morrisey, was considered a landmark in the implementation of Health Secretary Robert F. Kennedy Jr.s’ “Make America Healthy Again” agenda. Kennedy has linked food dyes to the epidemic of chronic disease afflicting Americans, especially conditions like autism, ADHD and cancer.
“Berger issued a 30-page ruling blocking enforcement of HB 2354, a law drafted by Del. Adam Burkhammer, R-Upshur, which bans food and pharmaceuticals that have been ‘adulterated’ with artificial compounds including butylated hydroxyanisole, Red 3, Red 40, Yellow 5, Yellow 6, Blue 1, Blue 2 and Green 3.

Junk-food Bans for SNAP Users To Begin in January
Beginning in January, 18 states will restrict the purchase of certain foods.
Indiana, Iowa, Nebraska, Utah, and West Virginia will implement purchase restrictions on 1 January, 2026. Idaho, Oklahoma, Louisiana, Colorado, Texas, Virginia, and Florida have starting dates from February to April. Arkansas, Tennessee, Hawaii, South Carolina, North Dakota, and Missouri will begin their bans between July and October.
Under the new rules, candy, soda and energy drinks, as well as some kinds of prepared foods, will not be available to SNAP recipients.
In Tennessee and Iowa, SNAP recipients will not be able to buy processed food, categorised as food that has been changed in any way from its natural state.
Prepared desserts will be off the menu in Florida and Missouri.
Meanwhile, in Iowa, foods that are prepared for consumption of come with eating utensils will be unavailable. Bread, fruit and canned goods will still be permitted.
Health Secretary Robert F. Kennedy Jr. said, “We cannot continue a system that forces taxpayers to fund programs that make people sick and then pay a second time to treat the illnesses those very programs help create.”

Immigrant truckers are taking legal action against California officials for plans to revoke their commercial driver’s licenses (CDLs), the news coming as the Democrat-controlled state faces heavy criticism after illegally issuing CDLs to foreign truck drivers.
The group of immigrant workers are suing California’s Department of Motor Vehicles (DMV), the Associated Press (AP) reported Tuesday.
“California officials said last month that the state notified about 17,000 truckers that their commercial driver’s licenses would be revoked because the expiration dates went past when the drivers were legally allowed to be in the U.S. That number has since grown to 21,000,” the outlet said.
